EMAILS and phone records between NRL boss David Gallop and News Ltd chief John Hartigan could be used in court as part of a legal bid to overturn the NRL's penalties against the Melbourne Storm for salary cap rorts.

It is believed lawyers for Storm chairman Rob Moodie and three of the club's independent directors plan to subpoena email and telephone records relating to the decision to strip Melbourne of two premierships, three minor premierships and all of their points this season.

Gallop, Hartigan and News Ltd's chief operating officer Peter Macourt could be asked to hand over their emails, as well as details of telephone discussions, from the period before the April 22 announcement of the tough penalties.

''We will seek every email, a record of every telephone conversation, every SMS message that Mr Gallop sent or received ahead of the decision being made,'' a source said. ''We may even ask for a forensic examination of computers and mirror hard drives if we have to, just in case anything has been deleted.''

Moodie and Storm directors Peter Maher, Petra Fawcett and Gerry Ryan claim Gallop, a former News lawyer, did not follow NRL procedures in penalising the club for its salary cap rorts. On Friday, they lodged a writ in the Victorian Supreme Court in which they claimed the game's governing body had acted outside its own rules and the Storm had been denied procedural fairness.

The directors are seeking to have the NRL's penalty set aside and an independent tribunal convened to hear the matter.

News Ltd papers have since reported Storm players and directors face a ''subpoena-a-thon'' by the NRL's lawyers, who could seek to have their personal financial affairs being aired in court.

Sources close to the Storm's legal team described such reports as a ''malevolent threat'' and said the NRL would have ''little chance'' of having such details heard by the court.

''It would all be irrelevant to the case, as it's the procedure that has not been followed here, the NRL did not follow its own rules in handing down this decision,'' a source said.

The correspondence between the NRL and News could also reveal who was privy to the penalties handed down to the Storm and, in particular, the stripping of premiership points for the 2010 season, before the news was made public. Bookmakers took several hundred bets on the Storm finishing last, and the club went from $251 to a $1.01 bet to win the wooden spoon within six hours. Betting was suspended by major bookmakers before the NRL went public.

Asked if the NRL would comply with any request to hand over Gallop's emails, spokesman John Brady replied: ''Responding to speculation about subpoenas is something we don't want to be involved with. There's a lot to happen before we get to that stage.''

News spokesman Greg Baxter said Storm's legal team was ''welcome to anything they want regarding News Ltd's executives'' and the NRL. ''What it will show is that no News Ltd executive knew about the penalties until the Thursday afternoon of April 22.''

Well, this has thrown a spanner into the works, Gallop (donkey) will see this as a threat in my opinion, and will be getting a little nervous if he isn't already.

I really see the Storm coming up trumps in this court case !!!

This sounds like preparation to drop Gallop/NRL right in it if the case doesn't go their way.
