there is no way bai and kearney meant to do this... and why is he suing the club.... it isnt there fault...it was jsut a freak accident.

well thats bullshit right thereMcCracken says the tackle was "intentional" and "done with intent to cause injury".
but i dont remember the tackle, so its not my place to say anything else

That has no bearing on the case at all. I can't see him winning the case though, as to win it he would have to prove that the intent of the tackle was to injure him, and not a case of a tackle gone wrong. There have been assault charges from sport before, such as Leigh Matthews and Neville Bruns, but that was a clear case of behind the play assault.Thunderstruck wrote:this is just flat out wrong

Kearney got 8 weeks, Bai got one. In my view it was a very bad tackle (and SK had had previous problems with his technique) but there was no intent to injure.
This will be an absolute disaster for Rugby League in Australia if the case is upheld. Players will start suing for any injury which shortens a career. The next step will be players suing ground staff over knee injuries. It has the potential to make the game (especially at junior levels) economically non-viable.

also{not saying its jarrods fault}but when you look at the tackle before he hits the ground he ducks his head in....if he doesnt do that he doesnt lend on his neck.

It is waaaaaaay to easy for something to go wrong in a tackle, to try and say that either player ment to do it as laughable.
What did Bai have to gain from this if it was intentional? Nothing that I can think of. Considering that before and after the incident Bai has always shown himself to be a good sport
Pretty much the same with Kearney. The only thing Kearney had to gain was maybe a rep spot, but then he was always the better player anyway. Kearney did have a bad history until he came to the Storm. Since then he has cleaned up his act.
Either way, how can you prove intent? I dont believe you can prove it 100%, which is what should be needed for McCracken to win. All evidence will be based of video and "expert" witnesses which both parties can counterclaim.... Bah...
Unfortunatly for McCracken his injury comes under the category of "Shit Happens". No one really wants it to happen, but career ending injury's do. It is a part of sport, he needs to grow up

How pathetic. From what I recall, Kearney was trying to drive Jarod, then Marcus got involved, and things got complicated.
Good Luck to him proving they went out there to intentionally end his career. Maybe he could get Marcus and Steve charged with attempted manslaughter too.

Why stop there? Why not sue the ground staff and MOPT for the playing surface damaging him when he came into contact with it? Sue the NRL for allowing Melbourne Storm to compete in the competition thus enabling a couple of the Storm's players to tackle him. Sue the coach for not getting this tackle style out of Kearney and Bai's repertoire. Hmm, who else?
