Remember that the new broadcasting laws state that NO FTA channel can bump a sports program only to HD first. It has to been shown on SD first or at the same time as HD.

I've been wondering about that law and how it impacts us in matters like this. The way the law reads is very grey on if each market is separate or it coves Australia as one market.
It is clear the FTA can not hoard ANY sport and that they must show it to 'most of the population' or PAY can and will have the right to show it.
It also is clear that FTA can not show any sport on HD without showing it on SD at the same time or before hand.
It is also clear that PAY can not show any FTA sport on replay until the FTA has shown it to 'most of the population' hence why Foxsports are not in a position to show League in the Melbourne market.
The difference with the Melbourne based code is that the FTA agreement allows PAY to show it in certain markets where FTA is not showing it only with approval and the terms set out by the FTA agreement.
Try getting the definition of 'most of the population' from the Ministers Office or the Broadcast Authority office is like getting the NRL to accept that they are responsible for the writing of the games broadcast agreement in the first place.
